Terms of Service

Welcome to Mikvah One. These Terms of Service ("Terms") govern your use of the Mikvah One website, booking platform, online store, and related services (together, the "Platform"), operated by Mikvah One LLC, a Florida Limited Liability Corporation ("Mikvah One," "we," "us," or "our").

By creating an account, booking an appointment, making a purchase, or otherwise using the Platform, you agree to these Terms. If you do not agree, do not use the Platform.

1. What Mikvah One is (and is not)

Mikvah One is a booking and management platform. Each mikvah listed on the Platform (a "Mikvah" or "Location") is an independent business or organization that is not owned, operated, or controlled by Mikvah One. When you book an appointment, your appointment is with the Mikvah, not with us. The Mikvah is solely responsible for its facility, its services, its staff, its hours, its policies, and your experience on its premises.

Mikvah One provides the technology that allows you to find Locations, book appointments, pay online where offered, and receive communications about your bookings.

2. Accounts

You must create an account to book an appointment online or to make a purchase from our store. You agree to provide accurate information and to keep your login credentials secure. You are responsible for activity that occurs under your account. You must be at least 18 years old to create an account and use the Platform.

Some Locations may accept walk-in visits recorded by their front desk without an online account. Information collected at the front desk is subject to our Privacy Policy.

3. Booking appointments

Availability and holds. When you select a paid appointment time, the time slot is held for a short period (currently 10 minutes) while you complete payment. If payment is not completed before the hold expires, the slot may be released to other customers.

Appointment policies are set by each Mikvah. Each Location sets its own appointment types, prices, hours, and cancellation policy. A Location's cancellation policy may allow cancellation at any time, allow cancellation only up to a cutoff period before the appointment, or require you to contact the Location directly to cancel. The applicable policy is shown during booking and on your appointment details.

Timezones. Appointment times are shown in the Location's local timezone, which is labeled during booking.

4. Payments, fees, and refunds

Payment processing. Online payments are processed by Stripe. When you pay for an appointment, your payment is made to the Mikvah through Stripe's Connect service; Mikvah One receives a platform fee from the transaction. Some Locations also accept payment in person, including cash, at their discretion.

Refunds for cancelled appointments. If you cancel a paid appointment in accordance with the Location's cancellation policy, a refund is generally issued automatically to your original payment method. Cancellations made more than 72 hours after the scheduled appointment time are subject to manual review before any refund is issued. Refund timing after issuance depends on your bank or card issuer. Cash payments made in person are refundable only by the Location directly.

Store purchases. Products sold in the Mikvah One store are sold by Mikvah One. Store payments are processed by Stripe. If a store order is refunded, the refund is issued to your original payment method. Shipping charges and product availability are shown at checkout.

Pricing errors. We reserve the right to cancel and refund any transaction made at an obviously erroneous price.

5. Communications: email and text messages (SMS)

Transactional email. By booking an appointment or placing an order, you consent to receive transactional emails about your bookings and orders (confirmations, reminders, cancellations, shipping updates).

SMS program. If you opt in to text messages, Mikvah One will send you appointment-related text messages such as booking confirmations and appointment reminders on behalf of the Locations you book with.

  • Consent. You opt in by checking the SMS consent box at signup or enabling SMS in your profile settings. Consent to receive text messages is not a condition of booking or purchase.
  • Message frequency varies based on your booking activity.
  • Message and data rates may apply.
  • Opt out at any time by replying STOP to any message. Reply HELP for help, or contact us at Shimysurkistest1@gmail.com.
  • Carriers are not liable for delayed or undelivered messages.
  • Your mobile number and SMS consent will not be shared with or sold to third parties or affiliates for their marketing or promotional purposes.

6. Your conduct

You agree not to: (a) use the Platform for any unlawful purpose; (b) book appointments you do not intend to keep or in a manner intended to deny availability to others; (c) attempt to access accounts, data, or systems you are not authorized to access; (d) interfere with the Platform's operation, including by circumventing rate limits or security measures; (e) scrape or harvest data from the Platform; or (f) misrepresent your identity.

We may suspend or terminate accounts that violate these Terms.

7. Privacy of appointment information

We take the discretion of appointment information seriously. Location staff see bookings identified by a booking code rather than your name by default; access to your name and phone number by Location staff is logged and requires a stated reason. See our Privacy Policy for details.

8. In-room tablets and messaging

Some Locations offer in-room tablets that display your first name during your appointment and allow you to message the attendant. Messages you send through the tablet are visible to the Location's staff and are retained as part of the Location's records on the Platform.

9. The Locations' responsibilities

Each Location is responsible for the accuracy of its listing (address, hours, photos, descriptions, amenities), the services it provides, its compliance with applicable laws, and the conduct of its staff. Mikvah One does not supervise, inspect, or endorse any Location and makes no representations about any Location's facilities or religious standards. Any dispute about services received at a Location is between you and that Location, though we may, at our discretion, assist in facilitating a resolution.

10. Intellectual property

The Platform, including its software, design, text, and logos, is owned by Mikvah One or its licensors and is protected by law. Locations retain ownership of the photos and content they upload, and grant Mikvah One a license to display that content on the Platform. You may not copy, modify, or distribute Platform content without our permission.

11. Disclaimers

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT PERMITTED BY LAW, MIKVAH ONE DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT ANY LOCATION WILL HONOR ANY PARTICULAR APPOINTMENT.

12. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW: (a) MIKVAH ONE IS NOT LIABLE FOR THE ACTS OR OMISSIONS OF ANY LOCATION OR ITS STAFF; (b) MIKVAH ONE IS NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS OR DATA; AND (c) MIKVAH ONE'S TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THE PLATFORM WILL NOT EXCEED THE GREATER OF (i) THE AMOUNTS YOU PAID THROUGH THE PLATFORM IN THE 12 MONTHS BEFORE THE CLAIM AROSE OR (ii) $100.

Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

13. Indemnification

You agree to indemnify and hold harmless Mikvah One and its officers, employees, and agents from claims arising out of your violation of these Terms or your misuse of the Platform.

14. Locations (mikvah operators)

If you operate a Location on the Platform, your use of the tenant tools is additionally governed by the agreement between your organization and Mikvah One, including fee terms, Stripe Connect onboarding requirements, payout schedules, and your responsibility for refunds and negative balances on your connected Stripe account.

15. Changes to the Platform and these Terms

We may modify the Platform or these Terms at any time. Material changes will be posted on this page with an updated effective date, and continued use of the Platform after changes take effect constitutes acceptance. If you do not agree to updated Terms, stop using the Platform.

16. Governing law and disputes

These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law rules. Any dispute arising from these Terms or the Platform will be brought exclusively in the state or federal courts located in Hillsborough County, Florida, and you consent to their jurisdiction.
